Workers' Compensation Insurance
When an employee is injured on the job, workers' compensation steps in to cover medical costs, lost income, and rehabilitation, protecting both the employee and your business from financial exposure. Getting the structure right matters.
Workers' compensation: protection for your employees and your business
Workers' compensation insurance pays for the costs associated with work-related injuries and illnesses, and provides your business with important legal protections in return. For any business with employees in physically demanding work environments, it is one of the most important coverage decisions you make.
What workers' comp covers
When a covered employee is injured or becomes ill due to work-related conditions, workers' compensation pays for:
In exchange for providing these benefits, employers who carry workers' comp receive significant legal protections; most notably, employees generally cannot sue the business in tort for covered workplace injuries. This protection can be critically important for businesses in high-risk industries such as construction, manufacturing, transportation, and trades.
A note on Texas
Texas is the only state where workers' compensation is not mandatory for most private employers. This gives Texas businesses a choice, but it is not a simple one. Employers who opt out give up the legal protections that come with coverage and face unlimited tort liability if an employee is injured and files suit. We work with Texas businesses to help them understand this decision, subscriber vs. non-subscriber, and make the right call for their situation.
Managing your Experience Modification Rate (e-mod)
Once you carry workers' comp, your premium is significantly influenced by your Experience Modification Rate (e-mod), a multiplier calculated based on your claims history over a rolling three-year period. A 1.0 is average. Below 1.0 reduces your premium. Above 1.0 increases it.
Your e-mod is not fixed. It responds to the claims you file, how quickly injured workers return to work, and the safety investments your business makes. Working with your advisor to understand and actively manage your e-mod is one of the highest-leverage things a growing company can do to control workers' comp costs year over year.
How quickly and effectively you return injured employees to modified or full duty directly affects your e-mod and your premiums over the following three years. We help clients build practical return-to-work frameworks as part of their workers' comp program.
Workers' comp isn't just a policy. It's a business decision.
Whether you carry it or are evaluating your current coverage, we can help you understand your exposure, your options, and the steps that protect both your business and your employees.
